By accessing or using the website located at moorheadconcrete.com (the "Site") or by engaging Moorhead Concrete ("we," "us," or "our") for any concrete contracting services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use this Site or engage our services.
Moorhead Concrete is a concrete contractor based in Moorhead, MN. We provide concrete installation, construction, and related services for residential and commercial properties, including but not limited to driveways, patios, sidewalks, foundations, retaining walls, and related flatwork.
All services are subject to a written scope of work agreed upon between Moorhead Concrete and the client prior to work commencing. Services not described in that written scope are not included unless separately agreed upon in writing.
Written estimates provided by Moorhead Concrete are valid for 30 days from the date of issue unless otherwise specified. An estimate is not a final contract. Final pricing is confirmed in a written agreement or proposal signed by both parties before work begins.
Estimates are based on information available at the time of the site visit. If conditions discovered during the project differ materially from what was observed at the estimate - such as underground utilities, undisclosed prior construction, or soil conditions significantly different from what was apparent - pricing may need to be adjusted. We will notify you of any such change before proceeding with the additional work.
Free estimates are provided at no obligation. Requesting an estimate does not create a contract or obligate either party to proceed.
Project scheduling is subject to weather conditions, permit approval timelines, and crew availability. Concrete cannot be poured safely in freezing temperatures or certain adverse weather conditions. We reserve the right to reschedule pours when weather conditions make it inadvisable to proceed.
If you need to cancel or reschedule a confirmed project, please notify us as early as possible. Costs already incurred - including permit fees paid on your behalf or materials ordered specifically for your project - may be non-refundable. Specific cancellation terms will be outlined in the written project agreement.
We reserve the right to cancel or postpone work due to factors outside our control, including but not limited to severe weather, material supply issues, or acts of God.
Payment terms are specified in the written project agreement. A deposit may be required before work begins. Final payment is due upon project completion unless otherwise agreed in writing.
Accepted payment methods will be communicated at the time of contract. Late payments may be subject to interest charges as permitted by applicable law. We reserve the right to suspend or terminate work on any project where payments are significantly overdue.
In the event of non-payment, Moorhead Concrete reserves the right to pursue all available legal remedies, including filing a mechanics lien on the property where allowed by Minnesota law.
Where permits are required for the work described in a project agreement, Moorhead Concrete will apply for and obtain required permits on your behalf as part of the project. Permit fees are typically included in the project estimate or itemized separately. The client is responsible for ensuring that the property owner has authorized the work.
All work performed by Moorhead Concrete is intended to comply with applicable local building codes and ordinances at the time of construction. We are not responsible for changes in code requirements after the work has been completed.

Moorhead Concrete is not liable for damage to underground utilities, irrigation systems, or other subsurface infrastructure that was not disclosed prior to work beginning.
Moorhead Concrete warrants that all work will be performed in a professional and workmanlike manner consistent with industry standards. Any warranty terms specific to a project will be stated in the written project agreement.
Concrete is a natural material subject to cracking, color variation, and surface changes over time. Minor cosmetic cracking, crazing, and color variation are inherent characteristics of concrete and are not considered defects. Our warranty does not cover damage resulting from improper use, the application of deicing salts, failure to follow post-pour care instructions, or events outside our control such as floods, frost heave, or acts of God.
Except as expressly stated in a written warranty, all services are provided "as is" and we make no other warranties, express or implied, including any implied warranties of merchantability or fitness for a particular purpose.
To the maximum extent permitted by applicable law, Moorhead Concrete shall not be liable for any indirect, incidental, consequential, or punitive damages arising from or related to our services or your use of this Site, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising from a specific project shall not exceed the amount paid to us for that project. Nothing in these terms limits liability for personal injury caused by our negligence or for fraud.
The content on this Site - including text, images, and other materials - is provided for informational purposes. You may not reproduce, distribute, or use Site content for commercial purposes without our written permission.
We make reasonable efforts to keep the Site accurate and up to date, but we do not warrant that all information is complete, current, or error-free. Prices, availability, and service offerings are subject to change without notice.

These Terms and Conditions are governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflict of law provisions. Any legal proceedings arising from these terms or our services shall be brought in the appropriate courts located in Minnesota.
We may update these Terms and Conditions from time to time. When we do, we will post the revised version on this page with an updated effective date.
